Who you are contracting with

These terms cover the licence for WCAG Radar. They do not cover an audit or consultancy from Proper Access; that comes with its own quote and its own agreements.
What you are buying
WCAG Radar is a browser extension and a bookmarklet that checks a web page against the WCAG guidelines. Most of the checks are free and will stay free, with no account and with nothing sent anywhere. A licence unlocks the remaining checks, plus the export of your test session.
There are two forms:
- A personal licencein one person’s name. It is not transferable and you cannot hand out seats with it.
- An organisation subscription from two seats up. You hand out the seats yourself in the portal, and you can withdraw them again.
Which checks sit behind the licence is listed on the pricing pageand in the tool’s own panel. That number grows: every check we build from here on is included at no extra cost. Checks that are free today will not be locked later.
A seat belongs to one person
Every seat belongs to one colleague and produces one key. Do not share that key with anyone else, not even within the same organisation. When someone leaves, withdraw their seat and hand it out again; the old key stops working.
We only keep a fingerprint of a key, never the key itself. If a colleague loses their key we cannot look it up, only replace it. Use the “New key” button on that seat.
Prices and VAT
Current amounts are on the pricing page, and they exclude VAT. If you buy as a private individual, checkout shows the amount including VAT.
- In the Netherlands we charge 21 percent VAT.
- If you are a business in another EU country with a valid VAT number, we reverse charge the VAT. That happens only when your number passes the European VIES check; a number you type in that cannot be verified does not count.
- Outside the EU we charge no VAT.
Payment and your invoice
You pay in advance, for the full term. Checkout runs through Mollie; we never see your bank account or card number. You need a billing address in your account before you can check out.
As soon as the payment arrives you get the invoice by email, with a PDF attached. That PDF is tagged, so it is readable with a screen reader. If you need a purchase order number on the invoice, put it in your account before you order.
Term and renewal
A personal licence runs for a year or a month, whichever you pick. An organisation subscription runs for a year.
A personal licence renews automatically until you cancel. The first payment is where you authorise the charges after it. If you pay by iDEAL, that first payment only signs the mandate and the renewal is collected by SEPA Direct Debit. If you pay by card, the renewal goes through that card.
An organisation subscription does not renew by itself. You get a payment link and pay each time. We send a reminder thirty days, seven days and one day before the end date.
If payment is late, licences keep working for 14 days after the end date. After that the paid checks close and the free part keeps working.
If you add seats mid-term, you pay pro rata for the remaining term and the end date stays where it is.
Cancelling
Cancelling is one button in the portal, not a letter or a phone call. Cancel whenever you want: there is no notice period and no minimum term after the first year or the first month.
Cancelling means nothing is charged again. Your licence keeps running until the end of the period you have already paid for. Prepaid time is not refunded, unless you use your right of withdrawal (below) or the fault is ours.
Right of withdrawal for consumers
If you buy as a private individual rather than for a business, you have fourteen days to withdraw. You do not have to give a reason. A message to info@properaccess.nl is enough; no form needed. We refund within fourteen days, using the same method you paid with.
There is one exception, and it is yours to choose. A licence works straight away, so at checkout we ask whether you want to start immediately. Ticking that box confirms you give up your right of withdrawal once your key is ready. The law requires that you make this choice explicitly, so without the tick we cannot deliver and checkout will not start. We record per order that you ticked it.
Business customers have no statutory right of withdrawal. If you are within two weeks of buying and have not used the licence, get in touch anyway; we usually work it out.
What the tool does and does not do
WCAG Radar helps you test for yourself. It points you, subject by subject, at what is on the page and what to look for. What it does not do is declare that your website meets WCAG.
No automated check finds everything. A large share of the accessibility requirements needs a person who looks, listens and walks through the page with a keyboard. A green result in the tool is therefore not proof of accessibility, not an accessibility statement, and no substitute for an audit. Decisions you base on it remain your own.
Availability
The tool runs in your own browser. No page content reaches us, so you can use it behind a login, on a staging environment or on localhost.
For the licence, the extension fetches a proof from us about once a day that stays valid for seven days. If we are down for a day, you will not notice. We promise no guaranteed uptime and no response time; we do promise to fix outages as soon as we know about them.
The Safari build has no licence. Apple requires paid features to run through the App Store, and that would leave us unable to invoice an organisation. In Safari, the free part is the whole product.
Liability
For damage caused by a mistake on our side, our liability is limited to the amount you paid for your licence in the preceding twelve months. We are not liable for consequential loss, lost revenue, or a fine from a regulator.
This limit does not apply in case of intent or deliberate recklessness on our part, and not where the law sets it aside for you as a consumer.
Your data
What we store and why is in the privacy statement. In short: for a licence we need your email address and your billing details, and of your key we keep only a fingerprint. What you test with the tool never reaches us.
We are required to keep invoices for seven years. If you leave, we delete your account but the invoices remain; we make the data in them unidentifiable where we are allowed to.
Changes
We may change these terms and our prices. Nothing changes for a term already running: a change takes effect at the next renewal, and we tell you before then. If you disagree, cancel before the renewal takes effect.
Complaints and applicable law
If something does not work or does not add up, email info@properaccess.nl. We reply within five working days and usually sooner.
Dutch law applies to this agreement. If we cannot resolve a dispute together, it goes to the court of Amsterdam. As a consumer you may instead always go to the court where you live, and you can file a complaint through the European Commission’s ODR platform.
